This site is normally accessible to users at all times. However, Someflu may decide to interrupt the site for technical maintenance purposes, in which case it will endeavor to inform users in advance of the dates and times of the intervention.

The site is regularly updated by the publication manager(s). Similarly, the legal notices may be modified at any time: they nevertheless apply to users, who are invited to refer to them as often as possible in order to become aware of them.

3. Description of Services

The purpose of the site is to provide information about all the company's activities. Someflu endeavors to provide the most accurate information possible on the site. However, it cannot be held responsible for omissions, inaccuracies and deficiencies in updating, whether these are due to its own fault or to that of third-party partners who provide this information.

All information on the site is provided for information purposes only and is subject to change. Furthermore, the information on the site is not exhaustive. It is provided subject to changes having been made since it was posted online.

4. Technical Limitations

The site uses JavaScript technology. The website cannot be held responsible for material damage related to the use of the site. Furthermore, the user of the site undertakes to access the site using recent equipment, free of viruses and with an up-to-date latest-generation browser.

5. Intellectual Property and Counterfeiting

Someflu owns the intellectual property rights or holds the rights of use to all elements accessible on the site, including texts, images, graphics, logos, icons, sounds, and software.

Any reproduction, representation, modification, publication, or adaptation of all or part of the site's elements, regardless of the means or process used, is prohibited without prior written authorization from Someflu.

Any unauthorized use of the site or any of its elements will be considered as constituting counterfeiting and prosecuted in accordance with the provisions of articles L.335-2 and following of the Intellectual Property Code.

6. Liability Limitations

Someflu cannot be held responsible for direct and indirect damage caused to the user's equipment when accessing the site, resulting either from the use of equipment that does not meet the specifications indicated in point 4, or from the appearance of a bug or incompatibility.

Someflu also cannot be held responsible for indirect damages (such as loss of market or loss of opportunity) resulting from the use of the site.

Interactive spaces are available to users. Someflu reserves the right to delete, without prior notice, any content posted in this space that would contravene applicable French legislation, particularly provisions relating to data protection.

Where applicable, Someflu also reserves the possibility of challenging the civil and/or criminal liability of the user, particularly in the case of messages of a racist, insulting, defamatory, or pornographic nature, regardless of the medium used (text, photograph, etc.).

7. Personal Data Management

In France, personal data is protected in particular by Law No. 78-87 of January 6, 1978, Law No. 2004-801 of August 6, 2004, Article L. 226-13 of the Penal Code, and the European Directive of October 24, 1995.

When using the site, the following may be collected: the URL of links through which the user accessed the site, the user's access provider, the user's Internet Protocol (IP) address.

In any case, Someflu only collects personal information relating to the user for the purpose of certain services offered by the site. The user provides this information with full knowledge, particularly when they enter it themselves. The user of the site is then informed whether or not it is obligatory to provide this information.

In accordance with the provisions of Articles 38 and following of Law 78-17 of January 6, 1978 relating to data processing, files, and freedoms, every user has the right to access, rectify, and object to personal data concerning them, by making a written and signed request, accompanied by a copy of their identity document with the holder's signature, specifying the address to which the response should be sent.

No personal information of the site user is published without the user's knowledge, exchanged, transferred, sold, or given to third parties on any medium. Only the hypothesis of the acquisition of Someflu and its rights would allow the transmission of said information to the possible purchaser who would in turn be bound by the same obligation to preserve and modify data vis-à-vis the site user.

Databases are protected by the provisions of the law of July 1, 1998 transposing Directive 96/9 of March 11, 1996 relating to the legal protection of databases.

9. Applicable Law and Jurisdiction

Any dispute in connection with the use of the site is subject to French law. Exclusive jurisdiction is granted to the competent courts of Paris.
